I acknowledge that by signing this document, I am assuming risks both for myself and for my child or ward as bicycling is an inherently dangerous sport and activity, and I fully realize the dangers of bicycling on public roadways, private paths, or elsewhere. Both for myself and for the person on whose behalf I execute this document, I agree to indemnify, not to sue, and to hold harmless the following persons and entities: The Guy On The Bike, LLC; Michael Secrest: and their respective agents, employees, volunteers, members, clubs, sponsors or any person, firm, insurer or association who might be responsible for them (collectively “Releasees”). I hereby waive, release, discharge, hold harmless, and promise not to sue the Releasees in connection with any and all causes of action which may accrue, including but not limited to, claims for personal or bodily injury or death, in connection with participation in the Ride Your Bike to School program, including claims arising from the Releasees own negligence to the maximum extent permitted by law. I agree that it is my sole responsibility to be familiar with the rules and regulations of the roadways which may be used in connection with bicycling and participation and agree to comply with all such rules and regulations. I understand and agree that participation in the Ride Your Bike to School program is strictly voluntary, and I assume all responsibility and liability for the dangers and risks associated with participation in the Ride Your Bike to School program. I have no physical or medical conditions which would endanger myself or others if I participate in the Ride Your Bike to School program, or would interfere with my ability to safely participate in the Ride Your Bike to School program.
I agree, for myself and my successors, that the above representations are contractually binding and not mere recitals. Every term and provision of this contract is intended to be serverable. If any one or more of them is found to be unenforceable or invalid, that shall not affect the other terms and provisions, which shall remain binding and enforceable.
